Terms of Service

Welcome to Siggold. These Terms and Conditions outline the rules and regulations for the use of Siggold's website and the IT services we provide.

By accessing this website and/or engaging our services, we assume you accept these terms and conditions. Do not continue to use Siggold if you do not agree to take all of the terms and conditions stated on this page.

1. Services Provided

Siggold is an IT company based in Kathmandu, Nepal, specializing in:

  1. Custom Web and Application Development (Next.js, React, Node.js, Flutter)
  2. SEO & Performance Optimization
  3. Ongoing Maintenance and Support
  4. Cloud Infrastructure and Backend Development
  5. Educational Platforms & Custom LMS

We agree to perform these services as outlined in the specific proposal, contract, or invoice agreed upon by both parties.

2. Project Execution and Timeline

  • Discovery & Strategy: We begin with a discovery phase to outline requirements and architecture.
  • Execution: We build your product with regular (often weekly) updates. While we strive to meet all projected timelines (such as our standard 6-week MVP delivery), development schedules are estimates and subject to reasonable adjustments.
  • Launch: Deployment and hand-off occur after final review and payment of all outstanding invoices.

3. Payment Terms

  1. A deposit (typically outlined in your specific project proposal) is required before any development work begins.
  2. Invoices are due upon receipt unless otherwise specified in your contract.
  3. Siggold reserves the right to halt work or withhold source code and deployment if payments are not made according to the agreed schedule.

4. Intellectual Property and Source Code Ownership

Unless explicitly stated otherwise in a separate contract:

  • Pre-existing Code: Siggold retains ownership of any pre-existing proprietary code, libraries, or frameworks used to build your project.
  • Client Ownership: Upon full and final payment, you will receive ownership of the final deliverables, including the source code specific to your project, allowing you to use, modify, and distribute it for your business purposes.

5. Maintenance and Support

We include 3 months of free bug fixes for our custom projects post-launch.

  1. "Bug fixes" cover errors in the code we wrote that cause the application to behave incorrectly compared to the agreed-upon scope.
  2. It does not cover new feature requests, third-party API changes, or server outages outside of our control.
  3. Extended maintenance or additional features require a separate agreement.

6. Limitation of Liability

Siggold shall not be held liable for any indirect, special, or consequential damages, including but not limited to loss of data, loss of revenue, or business interruption arising out of the use or inability to use our deliverables, even if we have been advised of the possibility of such damages.

7. Client Responsibilities

You agree to provide timely feedback, assets, passwords, and approvals required for us to perform our services. Delays in client communication may result in adjusted project timelines.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of Nepal. Any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of Nepal.

9. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will notify users of any changes by updating the "Last Updated" date at the top of this page.
